The state agency agrees not to fight a bill that ends its authority to order CCOs to return payments it has already made, while winning clearer language that the agency is free to abide by the orders of the federal government to do so if necessary. In a response to a letter from CMS approving rates for 15 of the CCOs, FamilyCare is now willing to accept half the state’s ordered clawback for 2015 as a compromise that could resolve its yearlong dispute with OHA.
